WHEN IS AN APPRAISAL REQUIRED FOR AN AG OR COURT-APPROVED TRANSACTION?

If your organization is a not-for-profit corporation acting under New York Not-for-Profit Corporation Law §§ 510, 511, or 511-a, or a religious corporation acting under Religious Corporations Law § 12, you’ll need Attorney General or Court approval before selling, leasing (for more than five years), mortgaging, or otherwise transferring real property — and the Charities Bureau requires a current, independent appraisal as an exhibit to your petition.

Timing matters. The Charities Bureau expects the appraisal to be obtained before the property is marketed or a deal is negotiated with a buyer, so your Board has an accurate picture of fair market value from the start. The appraisal must also be commissioned by the seller — never adjusted to suit a particular buyer — and prepared by an appraiser with no relationship to either party.

A Restricted Report delivers only the certified opinion of value without the supporting discussion, and is intended solely for the client’s internal use.
